These Terms of Service ("Terms") govern your access to and use of the website, software, and automated trading bots (each, a "Bot") offered by Vantage Point Trading, LLC ("Vantage Point Trading," "we," "us," or "our"). By creating an account, subscribing to a Bot, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
Vantage Point Trading provides rules-based, fully automated futures trading software. Each Bot executes a fixed, predefined strategy against the futures market(s) described on our Product pages. Our services are software licensing and execution tools only — we do not provide personalized investment advice, and no communication from Vantage Point Trading should be construed as a recommendation to buy or sell any security or futures contract.
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use our services. You are responsible for ensuring that your use of a Bot complies with the rules of your brokerage firm, proprietary trading firm, and any applicable laws or regulations in your jurisdiction.
Certain Bots require a one-time setup fee and a recurring monthly subscription, as described on our Pricing page. Subscriptions are billed monthly and may be cancelled at any time; cancellation stops future billing but does not refund fees already paid, except where required by law. We reserve the right to change our pricing with reasonable advance notice to active subscribers.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Bot(s) you've subscribed to, solely for your own personal or business trading activity. You may not resell, sublicense, copy, reverse engineer, or redistribute any Bot or related software.
Each Bot follows a fixed, disciplined, rules-based strategy — it does not make discretionary decisions, and it does not take instructions from Vantage Point Trading staff on a trade-by-trade basis. Nothing provided through our services constitutes investment, financial, tax, or legal advice. You are solely responsible for deciding whether to use a Bot and for monitoring its activity.
Vantage Point Trading never takes custody of your funds and does not have login access to your brokerage or trading account. Bots connect to your account through a secure, limited connection solely for the purpose of placing trades according to their predefined ruleset. You retain full control of your account at all times and may manually intervene, override, disable, or exit any position at any time. For more detail, see our Risk Disclosure.
You are responsible for opening and maintaining your own account with a licensed broker or proprietary trading firm, for funding that account, and for complying with its rules, margin requirements, and fees. Vantage Point Trading is not affiliated with, and is not responsible for, the acts, errors, omissions, or financial condition of your broker or prop firm.
Futures trading involves substantial risk of loss and is not suitable for all investors. Past performance — whether actual or hypothetical — is not necessarily indicative of future results. You acknowledge that you may lose some or all of the funds in your trading account and that you are using our services entirely at your own risk.
Our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted operation, or error-free performance. We do not guarantee any level of trading performance or profitability.
To the maximum extent permitted by law, Vantage Point Trading, LLC and its officers, employees, and affiliates will not be liable for any trading losses, lost profits, or indirect, incidental, special, or consequential damages arising from your use of our services, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless Vantage Point Trading, LLC from any claims, damages, or expenses arising out of your use of our services or your violation of these Terms.
You may stop using our services and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or misuse our services.
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
